Please read these Terms of Service ("Terms") carefully before using nosystem.chat (the "Service") operated by November LLC ("us", "we", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Description of Service

nosystem.chat is a minimalist interface ("wrapper") that allows users to interact with various third-party Large Language Models (LLMs) via their APIs. We provide the interface, storage of history, and routing of requests. We do not own or develop the underlying AI models (e.g., GPT, Claude, Gemini).

2. Accounts

When you create an account with us, you guarantee that the information you provide is accurate, complete, and current. You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.

3. Usage and Conduct

You agree to use the Service only for lawful purposes. While nosystem.chat does not enforce its own system prompts or content filters ("No System"), you are strictly prohibited from using the Service to:

Generate Content that violates the Acceptable Use Policy of the underlying Model Provider (e.g., OpenAI, Anthropic, Google).
Generate Child Sexual Abuse Material (CSAM).
Generate malware, phishing scams, or engage in cyberattacks.
Harass, abuse, or harm another person or group.

We reserve the right to terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

4. Billing, Credits, and Refunds

Pricing Model: The Service operates on a subscription basis which includes a set amount of usage credits, followed by metered billing for overage.
Credits: Monthly credits provided as part of the subscription do not roll over.
No Refunds: Payments for subscriptions and used credits are non-refundable.
Pricing Changes: We reserve the right to modify pricing or platform fees with reasonable notice. Continued use of the Service after a price change constitutes agreement to the new pricing.

5. Intellectual Property

The Service and its original content (excluding content provided by you or AI models), features, and functionality are and will remain the exclusive property of November LLC.

6. Content and Output Ownership

Your Inputs: You retain ownership of all text and instructions you input into the Service.
AI Outputs: Subject to the Terms of the underlying AI Model Provider, rights to the output generated by the AI are assigned to you.

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

No Liability for AI Output: We act as a conduit for third-party AI models. We are not responsible for, and disclaim all liability regarding, the accuracy, safety, legality, or quality of the content generated by these models. The models may "hallucinate" (generate false information) or produce offensive content.
Uptime: We do not warrant that the Service will be uninterrupted, secure, or available at any particular time or location.

8. Limitation of Liability

In no event shall November LLC, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of or inability to access or use the Service;
Any conduct or content of any third party on the Service;
Any content obtained from the Service; and
Unauthorized access, use or alteration of your transmissions or content.

To the maximum extent permitted by applicable law, our total liability to you for any damages arising from or related to these Terms is limited to the amount you paid us in the past 12 months.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Colorado, United States, without regard to its conflict of law provisions.

10. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
